Terms of Service

Definitions

The following definitions are used unless the context requires otherwise:

  • Global Alumni encompasses the Global Alumni environment and includes the globalalumni.org web page and the Global Alumni online learning platform.
  • You signifies a person who has enrolled in a course.
  • Penn ELP means Penn English Language Programs.
  • Course signifies a Penn ELP course offered by Global Alumni in collaboration with Penn ELP and the Global Alumni environment.
  • Website refers to the Global Alumni virtual campus and any other website utilized in a course or in collaboration with a course.
  • Website content includes all content published on the website, including but not limited to text, exams, videos, images, and other instructional materials provided in relation with the course offered on the website, such as user posts.
  • User refers to any person utilizing the website, including the person who has registered for a course under these terms.
  • User account means an account created with Global Alumni and regulated under these terms.
  • User posts implies all content admitted, published, or distributed on the website by you or other users, including, among others, all forum publications, Wiki pages, notes, questions, comments, videos, and uploaded documents.

Scope

By enrolling in a course, you are signing a contract with Global Alumni and agree to follow these terms, which also include the following:

Enrollment and Payment

Restrictions

Penn ELP reserves the right to accept or reject any enrollment in a course.

Enrollment Process

Unless otherwise agreed upon with Global Alumni, you must complete the registration process within one day of the course start date. Keep in mind that once enrollment has closed, cancelations and late registrations cannot be guaranteed.

Payment

Global Alumni will handle the process of collecting payment details, and you will be redirected to a secure website, to complete the payment.

Once your payment is complete, you will receive an enrollment confirmation email within 24 to 48 hours. Please save this email in your records since it may be necessary for future requests related to this course.

If you are unable to complete the payment, please contact Global Alumni at the following email address: admission.pennelp@globalalumni.org and they will collect your bank information to complete a bank transfer.

Split Payment

  1. Once the first installment is paid, which is 65% of the total price, you will be able to receive your login credentials for the virtual campus platform when they are issued.
  2. The second installment payment, which is 35% of the total price, must be paid within the first 20 days of the course/program start date.
  3. If payment confirmation of the second installment is not received, you will not be able to continue with the course/program, your login credentials will be suspended, and you will no longer have access to the virtual campus platform and its contents. In this case, you will not be eligible for a refund of the first paid installment.
  4. Once the payment confirmation for the first installment is received, you will not be eligible for a refund for the course/program and cohort.

Cohort Change Policy

  1. Participants can register a maximum of two times in the same program.
  2. Participants can request a change in cohort and register for the next cohort by paying an administrative fee of $300 USD.
  3. Cohort change requests must be carried out under the following criteria:
    1. Communication period and fee payment: within the first 21 days of the cohort start date for the program. Requests submitted after this date will not be eligible for change.
    2. Means of communication: Requests should be sent by email to the following address: onlinelearning.pennelp@globalalumni.org
    3. Payment: Fee payments should be completed and the administration notified within the first 21 days of the cohort start date.
  4. Exceptions: Cohort change requests due to medical reasons or other justified reasons, including force majeure, during the communication and payment period (21 days from the program’s cohort start date) will be exempt from paying the administrative fee of $300 USD provided that the request is carried out within the communication period, sent to the email address indicated above, and accompanied by corresponding documentation (medical, police, or psychiatric reports, etc.). Once the request has been received, the academic committee will review it to determine whether or not it is admissible.
  5. Cohort changes will not be allowed for any reason beginning 22 days after the cohort start date.

Refund Policy

  1. If the participant communicates that they will drop the course before the cohort start date, the fee paid will be returned in full, minus a $300 USD administrative fee.
  2. Cancellation requests and reimbursements will be carried out under the following criteria:
    1. Communication period: before the initial start date of the program cohort. Requests submitted after this date will not be eligible for reimbursement.
    2. Means of communication: Requests must be submitted by email to the following address: onlinelearning.pennelp@globalalumni.org
  3. Participants will not be eligible for a reimbursement after the initial start date of the program cohort.
  4. Please review Split Payment section for details on this matter.

Discount Codes

Any applicable discount code should be used at the time of enrollment in order to receive said discount. Discounts cannot be applied after the enrollment form has been sent. Discounts cannot be applied to promotional rates.

Taxes

Unless expressly stated otherwise, all prices or amounts payable by you for a course are exclusive of any sales tax, value-added tax, goods and services tax, or other taxes.

Admission Survey

You are required to provide some personal information through a short obligatory survey. Failing to provide this information may mean that you will be unable to access the course materials.

User Account and Website

Account Information

To take part in the course you must set up an account and username, and:

  1. Provide the required accurate and up-to-date information about yourself;
  2. Maintain and update your information to keep it current;
  3. Protect your account user information and any other course credentials, not giving them to any other person; and
  4. Not share under any circumstance the user access information for your account or website with a third party.

Acceptable Use

You must use the website according to:

  1. These terms, including the Privacy Policy and Code of Conduct.
  2. All applicable international, national, state, and local laws, rules, and regulations, including copyright laws; and
  3. Any law referring to the transmission of technical data exported from your country of residence, and all United States laws regarding the control of exports.

User postings

User postings representations and warranties

By submitting or distributing your user postings, you affirm, represent and warrant (1) that you have the necessary rights, licenses, consents and/or permissions to reproduce and publish, the user postings and to authorize Penn ELP and its users to reproduce, modify, publish and otherwise use and distribute your user postings in a manner consistent with the licenses granted by you below, and (2) that neither your submission of your user postings nor the exercise of the licenses granted below will infringe or violate the rights of any third party. You, and not Penn ELP, are solely responsible for your user postings and the consequences of posting or publishing them.

License grant to Penn ELP

By submitting or distributing your user postings, you hereby grant to Penn ELP a worldwide, non-exclusive, transferable, assignable, sub licensable, fully paid-up, royalty-free, perpetual, irrevocable right and license to host, transfer, display, perform, reproduce, modify, distribute, re-distribute, relicense, and otherwise use, make available and exploit your user postings, in whole or in part, in any form and in any media formats and through any media channels (now known or hereafter developed).

License grant to Penn ELP

By submitting or distributing your user postings, you hereby grant to each user of the Site a non-exclusive license to access and use your user postings in connection with their use of the Site for their own personal purposes.

Record of Completion

When you have successfully completed your course, you will receive a digital certificate of course completion from Penn ELP. The certificate of completion is an official document digitally signed and certified by Penn ELP. All courses and professional certificates completed with Penn ELP will be archived (and confirmed upon request) by Penn ELP.

Trademarks and Copyright

Penn ELP

The “Penn ELP” names, logos, and seals are registered Penn ELP trademarks. You must not use any of these symbols or any variation of them without prior written consent from Penn ELP. You must not use any of these symbols or any variation of them for commercial purposes, or in any way that suggests or affirms deliberately or indeliberately, or under Penn ELP’s sole discretion, that the impression or appearance of such a use is approved by or related to Penn ELP.

Others

All registered trademarks that are not the property of Penn ELP that appear on the website or through the services available on the website, including registered trademarks that are the property of Global Alumni, are the property of their respective owners.

Nothing in these terms or the website content should be interpreted as a concession by implication, impediment, or otherwise as a license or right to use any registered trademark presented on the website without prior written consent of the owner.

Copyright Infringement

Copyright holders who believe that their material has been violated on the website should contact our designated copyright agent at onlinelearning.pennelp@globalalumni.org

The notification must include:

  1. Identification of the copyright work, or, in the case of more than one instance of affected work in the same location, a representative list of said work on the website;
  2. Identification of the material allegedly infringed or infracted upon, including enough information to locate the material (e.g., URL, IP address, device name);
  3. Claimant’s contact information (e.g., email address, phone number); and
  4. A statement in which the claimant indicates that he or she believes the use of material was not authorized by the copyright owner or associated authoritative power.
  • Your Indemnity to Us

Indemnity

You agree to defend, release all responsibility, and indemnify Penn ELP and Global Alumni from and against any third-party claim, demand, loss, expense, damage, or cost (including attorney fees and costs) generated by, derived from, or related to your:

  1. Use of the website;
  2. Failure to comply with any of these terms; and
  3. Failure to comply with the copyright or trademark.

Our Limitation of Liability and Disclaimer

Sole Risk

You:

  1. Utilize the website, the content, and the services obtained from or through the website under your own risk;
  2. Access or download information, materials, or data from the website or any site referenced at your own risk and discretion; and
  3. Are totally responsible for any damage to your property (including computer systems) or loss of data that occurs from the download or use of said material or information, unless expressly stated otherwise by Penn ELP or Global Alumni.

Links to Other Websites

The website may include hyperlinks to websites managed or controlled by others and:

  1. Access linked third-party websites at your own risk; and
  2. Penn ELP and Global Alumni are not responsible for and don’t routinely inspect, approve, review, or reinforce the content or use of any of the products or services that may be offered on other websites.

No Guarantees

Penn ELP and Global Alumni:

You:

  1. Provide the website and any information, content, or available services on or through a website as is and according to availability with no guarantee (express, implicit, or otherwise), including, but not limited to, implied commercial warranties, fitness for a particular purpose, availability, and non-infringement, except to the extent that such implied warranties cannot be disclaimed under the applicable law;
  2. Do not guarantee that the website will function uninterrupted or without error, that the website is free of viruses or other harmful elements, or that the planned course or content will satisfy your needs or expectations;
  3. Make no guarantee as to the suitability, complexity, or timeliness of the website or any course or content, or that any particular course or content will remain available; and
  4. Are not responsible for any loss or damage, whether current or temporary, caused by or related to these terms, or due to your use of or inability to use the website, your allocation of the material on the website, or your reliance on material obtained through the website, regardless of whether your complaint is based on the contract, tort, statute, or other law; and

To the maximum extent permitted by law, are not liable for any consequential, indirect punitive, special, exemplary, or incidental damages, whether foreseeable or unforeseeable, and whether or not they were negligent or at fault (including, but not limited to, defamation claims, errors, loss of profits, loss of data, or interruptions in the availability of information).

Others

Transfer

Global Alumni may assign or take control of any right or obligation under these terms. You may not transfer or deal with your rights or obligations under these terms or try to do so.

Total Agreement

These terms contain the full contract between you and Global Alumni regarding the matter at hand. These terms present the only conduit on which you may rely and supersede all previous conduits and agreements between Global Alumni and yourself regarding the courses and the subject matter of these terms.

Disclaimer

Failure to execute or any delay in exercising a right, power, or recourse under these terms serves as a wavering of said rights. A simple or partial execution of any right, power, or recourse does not prevent the exercise of that or any other right, power, or recourse. A waiver is not valid or binding unless it is in writing.

Severability

The illegality, invalidity, or enforceability of any provision in these terms under any law will not affect the legality, validity, or enforceability of said provision under any other law or the legality, validity, or enforceability of any other provision.

Modification

Failure to execute or any delay in exercising a right, power, or recourse under these terms serves as a wavering of said rights. A simple or partial execution of any right, power, or recourse does not prevent the exercise of that or any other right, power, or recourse. A waiver is not valid or binding unless it is in writing.

Disclaimer

Global Alumni reserves the right to modify these terms at any time without prior notification. Any change will be effective immediately from the time of publication on the website. Accessing the website after any change has been made will constitute your consent to the modified terms going forward.

Third-Party Rights

Penn ELP is a third-party beneficiary of these terms, and each one may apply these terms directly as long as it is in their interest.

Applicable Legislation and Jurisdiction

This agreement is governed by the laws of the Pennsylvania, in the United States of America, and you thereby agree to the non-exclusive jurisdiction of the courts of Pennsylvania.

ANNEX

Code of Student Conduct - Penn ELP

  1. Preamble

    When Benjamin Franklin founded the Pennsylvania Academy, he defined its mission as “education for citizenship.” In pursuit of this mission, the University of Pennsylvania is committed to achieving academic excellence, to creating an environment for inquiry and learning, and to cultivating responsible citizenship in the larger society.

    The University of Pennsylvania is a community in which intellectual growth, learning from others, mutual tolerance, and respect for freedom of thought and expression are principles of paramount importance. In an environment that promotes the free interchange of ideas, cultural and intellectual diversity, and a wealth of social opportunities, Penn students take advantage of the academic and non-academic opportunities available to them, deepening their intellectual insights through formal instruction, and expanding their educational experience beyond their academic programs. Members of the Penn community participate actively in the greater Philadelphia, state, national, and international communities in which they reside. “Citizens” of the University community include students, faculty, staff, and those otherwise affiliated with the University.

    Accepting membership into the University of Pennsylvania community as a student entails an obligation to promote its welfare by assuming the rights and responsibilities listed below. Each individual member of this community is responsible for his or her own actions and is expected to respect the rights of others.

  2. Rights of Student Citizenship

    Membership in the University of Pennsylvania community affords every student certain rights that are essential to the University’s educational mission and its character as a community:

    1. The right to have access to and participate in the academic and non-academic opportunities afforded by the University, subject to applicable standards or requirements.
    2. The right to freedom of thought and expression.
    3. The right to be free from discrimination on the basis of race, color, gender, sexual orientation, religion, national or ethnic origin, age, disability, or status as a disabled or Vietnam Era veteran.
    4. The right to fair University judicial process in the determination of accountability for conduct.
  3. Responsibilities of Student Citizenship

    Students are expected to exhibit responsible behavior regardless of time or place. Failure to do so may result in disciplinary action by the University. Responsible behavior is a standard of conduct which reflects higher expectations than may be prevalent outside the University community. Responsible behavior includes but is not limited to the following obligations:

    1. To comply with all provisions of the University’s Code of Academic Integrity and academic integrity codes adopted by the faculties of individual schools.
    2. To respect the health and safety of others. This precludes acts or threats of physical violence against another person (including sexual violence) and disorderly conduct. This also precludes the possession of dangerous articles (such as firearms, explosive materials, etc.) on University property or at University events without University authorization.
    3. To respect the right of fellow students to participate in University organizations and in relationships with other students without fear, threat, or act of hazing.
    4. To refrain from conduct towards other students that infringes upon the Rights of Student Citizenship. The University condemns hate speech, epithets, and racial, ethnic, sexual, and religious slurs. However, the content of student speech or expression is not by itself a basis for disciplinary action. Student speech may be subject to discipline when it violates applicable laws or University regulations or policies.
    5. To refrain from stealing, damaging, defacing, or misusing the property or facilities of the University or of others. This also precludes the disruption of University computing services or interference with the rights of others to use computer resources.
    6. To be honest and truthful in dealings with the University, about one’s own identity (e.g., name or Social Security number), and in the use of University and other identification.
    7. To cooperate fully and honestly in the Student Judicial System of the University, including the obligation to comply with all judicial sanctions.
    8. To comply with all contracts made with the University, such as Residential Living Occupancy Agreements and Dining Services contracts.
    9. To comply with policies and regulations of the University and its departments (e.g., the University’s Guidelines on Open Expression, Anti-Hazing Regulations, Drug and Alcohol Policies, Sexual Harassment Policy, etc.).
    10. To comply with federal, state, and local laws.
